1. Who we are

The Trendtrack marketplace (the "Marketplace") is operated by HVSCALE SERVICES - FZCO, registered under license number 001 - 55425, with its office at IFZA Business Park, DDP, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates ("we", "us", "our"). It is the same company that operates trendtrack.io.

These terms govern your use of the Marketplace: its website, your account, and every feature on it. By creating an account or using the Marketplace you accept them. If you do not, please do not use it. Our privacy policy explains how we handle personal data and is part of these terms.

2. What the Marketplace does

The Marketplace puts ecommerce brands ("buyers") in touch with agencies and freelancers who sell ecommerce services ("sellers"). Sellers publish profiles, case studies and services ("gigs"). Buyers search them, publish requests describing what they need, and contact sellers through the Marketplace's messaging.

The Marketplace is a place to meet. Buyers and sellers agree on scope, price, timing and payment between themselves. We are not a party to those agreements, we do not employ sellers, we do not act as an agent for either side, and we do not take or hold payments for the work. Each side is responsible for checking the other and for the agreement they make.

The Marketplace is free to use today. If we introduce fees, we will say so before they apply to you.

3. Accounts

You need an account to contact a seller, publish anything or write a review. You agree to give accurate information, to verify your email address, and to keep both up to date. Sign up may be limited to people we have invited; an invite admits only the address it was sent to.

Each account is for one person. Keep your password to yourself: you are responsible for what happens under your account. Tell us at contact@trendtrack.io if you think someone else has used it.

We may refuse an account, or suspend or close one, when its information is false or misleading or when it breaks these terms.

4. Sellers, agencies and gigs

A seller is either a freelancer or an agency. The person who creates an agency owns it: they can invite members, give them roles and remove them, and they answer for what the agency and its members publish and say on the Marketplace.

Everything a seller publishes must be true and theirs to publish: their identity, team, locations, rates, past work, client names and results. Case studies must describe real work you did, with the client's permission where it is needed. A gig must describe a service you actually offer.

New gigs are reviewed by our team before they appear, and changes to a live gig may be reviewed after they appear. We may refuse or unpublish a gig, and act on the seller's account (see section 11), when it breaks these terms, is misleading or falls outside ecommerce services.

5. Buyers and requests

A buyer request describes a project. It must be a real need, described honestly, with no personal data about other people. A request is reviewed before it is published on the request board, and changes to a live request may be reviewed after they appear. A budget on a request is an indication for sellers, not an offer we guarantee.

6. Messages

Messages are between the people in a conversation. Use them to discuss work: no spam, no bulk or automated outreach, no harassment, and no attempt to collect other members' data for anything but the project you are discussing.

We do not read conversations as a matter of course. Our team may look at a conversation when someone in it reports a problem, when we have reason to suspect fraud or abuse, or when the law requires it.

7. Reviews

Any member with a verified email address can review a seller. A review must reflect your own, real experience of working with that seller. You may not review yourself, your own agency or a competitor, write a review in exchange for anything, or ask for a review to be written, changed or removed in exchange for anything.

Reviews are checked by our team before they appear. We publish positive and negative reviews alike, and we refuse or hide a review only when it breaks these terms (for example a fake review, a personal attack, or personal data about someone). Only published reviews count in a seller's ratings.

8. How listings are ranked

Search results are ordered first by how well a gig matches the search (its words and their meaning), then by the seller's reputation, an internal score that is not shown publicly. Reputation orders results among comparable matches; it does not lift a weaker match above a clearly better one. Seller directories list the most trusted sellers first. The request board shows the newest requests first, moved up or down a little by the buyer's reputation.

Every account starts from the same score. It then moves with published reviews (their average and their number), whether the seller is verified, and decisions by our team: adjustments, restrictions, bans, and boosts for sellers we choose to highlight, capped so that a boost alone never reaches the top score. Boosts are an editorial choice and are not sold: nobody can pay for a better place in the results today. Banned accounts are left out of lists.

9. Your content

You keep the rights to what you publish: text, images, videos, reviews and messages. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display and show it on the Marketplace and in links to it (search engines, social previews), for as long as it is on the Marketplace and for a reasonable time after you remove it.

You confirm you have the right to publish what you upload, and that it does not infringe anyone's rights or break the law. We remove the hidden metadata (such as location) from images you upload.

10. Acceptable use

You may not:

  • offer, request or promote anything illegal, deceptive or harmful;
  • impersonate a person, company or brand, or misrepresent who you work for;
  • access the Marketplace by automated means (scripts, bots, scrapers, crawlers beyond the pages search engines are allowed to index), or copy its listings, profiles or reviews in bulk;
  • get around rate limits, reviews, bans or other protections, for example by opening several accounts;
  • upload malware, or try to reach data or systems you are not allowed to;
  • use the Marketplace to build a competing directory or dataset.

11. Moderation, suspension and closing your account

Our team reviews gigs, requests and reviews, and may act on accounts that break these terms. Depending on what happened, we may refuse or unpublish content, limit what an account can do, lower its place in results, or suspend or close it. Where the law allows, we tell you what we did and why. You can contest a decision by writing to contact@trendtrack.io. A person on our team will look at it again.

You can stop using the Marketplace at any time. To close your account and delete its data, write to contact@trendtrack.io from the address on the account.

12. Our intellectual property

HVSCALE SERVICES - FZCO owns or holds a license for the Marketplace: its software, design, databases, the selection and arrangement of its content, and the Trendtrack name and marks. Apart from your own content, you may use them only to use the Marketplace as these terms allow.

13. Disclaimers and liability

We provide the Marketplace as it is. We do not check every seller's skills, results or references, and we do not guarantee the outcome of any project, the accuracy of what members publish, or that the Marketplace will always be available or free of errors.

To the fullest extent the law allows, we are not liable for indirect losses (such as lost profit, revenue, data or business), or for anything arising from an agreement between a buyer and a seller, or from what a member does or publishes. Nothing in these terms limits a liability that the law does not allow us to limit.

14. Changes

We may change the Marketplace and these terms. When a change matters, we will tell you before it applies, on the Marketplace or by email. Using the Marketplace after the change applies means you accept the new terms.

15. Governing law and disputes

These terms are governed by the laws of the United Arab Emirates. If a provision is found invalid, the rest stays in force.

Send complaints to contact@trendtrack.io. If we cannot settle a dispute together, it may be referred to mediation under the rules of a recognized mediation body. If litigation becomes necessary, the courts of Dubai, United Arab Emirates have exclusive jurisdiction, unless the law requires otherwise.
